Rape, The Death Penalty & A Modest Proposal for Reformed Justice

I have two daughters. I'm told that rape is not primarily a sexual crime. I’m told it is a personal power crime. Bull ! What is important is how I feel as a father. The rapist is forcing an act that takes away the victim’s right to choose a loving, caring sexual partner. This is a crime against God.

It is also a social crime that deserves the severest punishment that can be provided – death. This a social behavior question It is a social problem. It is a religious problem. Rape is also a crime with a very high recidivism rate.

There is a very high likelihood that a rapist will rape again. This calls for either a lifetime without a penis for the first crime of this nature, or more simply, death. I’ll be generous, the convict could choose.

The original concept of ostracism was a death penalty sentence. It was a common understanding as it was believed that a single individual could not long survive in the wilderness alone. It was also another reason that lone individual newcomers were to be feared. What had they done to be sent out alone?

Today with decades of safe and secure prison life, we drive the prisoners insane. We transform them into sexually perverse persons unable to cope with living in a free society. The only possible exception to recidivism is to keep them imprisoned until they are in their seventies. Possibly even older as then they are probably too old and feeble to be dangerous to others any more.

This cost is simply too expensive for society to bear. A prisoner that is convicted of a violent crime is too dangerous. When the crime is murder, rape, aggravated armed robbery, etc. which demands more than a 5 to 7 year prison term. The convicted should instead be quickly and quietly executed.

There should be a maximum delay of 90 days for appeals from judgment to execution. These violent offenders are simply too dangerous to society to be kept alive. Prisons are notoriously unable to keep them from escaping. Prisoners cannot be released safely back into society. Prisoners cannot be released even with a reasonable time period with training for a new job and life style.

The U. S. justice system is a bad joke, at best. The court room should be a place to find truth. I suggest that even if that means drugging the prisoner to get the truth. Sodium pentathol, or similar inhibition reducing drug, even if injected against his/her will could get to the truth. This method should also be used with any other vital witnesses. Questioning under medical supervision and the direct observation of the judge and jury is the quickest way to find the guilt, or innocence, of the accused.

No one should be excused from being called to testify in a criminal case if it is a death penalty case. All scientific tests should also be demanded to determine proof of guilt. Trials should be quick, lasting no more than two weeks. Courtrooms and justice will be better served if all lawyers are made accountable for seeking justice. I believe that all criminal lawyers should be sworn officers of the court. Together with severe penalties, lethal penalties, for transgressions of this trust.

Criminals make free will decisions. By their actions they show that they do not care about the laws of society. At some level of seriousness of the crime, the punishment should be equal to the pain and suffering inflicted on the victims. God is not going to punish them, He will only learn from them in time. These actions are by people and may or may not be religious sins.

They are definitely uncivil actions. Actions that are not good for the calm, easy interactions of family, society, and commerce. Civil society can choose to efficiently protect its members. Civil society can do this if it cares enough. It must spend enough of its resources to protect its citizens from those who make the decisions to be hurtful to others.

If the civil society of which you are a part does not care enough about you to protect you? Why then would you presume to ask God to do it for you? You can at least affect civil society. You can do something. You cannot affect God's Laws. Go to work to do something about this disastrous failure of civil society.

Do something positive that will begin to make a difference for the future. Change something that will change civil society. Run for office to change the laws. Vote for candidates that will, not just promise, but will positively change the laws.

You can join a political party. You can make contributions of money and your time to your choice of political party and candidates of your choice. You can register voters. You can get out the vote on election day.

If you do not care enough to do these things, you are allowing those who do care, to make your choices for you. If you do this long enough, you will lose your freedom of choice. You will lose your ability to exercise your free will. At that point, your inactions have become a religious sin.

Evil is the result of random chance. Evil is much more commonly created through the results of free-will decisions by others. You need to be prepared as an individual. When we are young, it is hoped that our parents are there to care for us and protect us. Yet, sooner, or later, we must become independent, and care for ourselves. That means to be prepared.

You need to be able to recognize when it might be best to vacate yourself from the street. You must be able to defend yourself. Society will not do it. Laws will not do it. The poilivce certainly will not do it. At most, law may provide some ‘revenge’, but only if law enforcement is extraordinarily effective and is able to catch the culprit. At best, that is one chance in a hundred.

When you are robbed, assaulted, car jacked, or ‘mugged’, your formally instructed ability to protect yourself is best. You can turn aside the knife strike or bludgeon’s blow. You can ram a sharp elbow with great force into the solar plexus of the mugger. This will be more likely to end with a result you will like. Compare this to waiting until after you get out of the hospital. Trying to identify the criminal. Swearing out a warrant. Bugging the police to get off their fat butts to arrest the crud that put you in the hospital.

Then having to insist that the public prosecutor do his job. Where is your right of justice when the prosecutor plea bargains away your right to seeing a speedy trial of the criminal? Most are elected officials. Help his opponent in the next election. Do a TV spot. Call the prosecutor who threw away your right to justice a dirty rat. Run against him yourself.

You might enjoy sitting through a trial. You might enjoy giving testimony. You might enjoy having your honesty challenged by some two bit, cheap $#&@*&+ lawyer. You might enjoy having to listen to lies about the angel perfect background of your assailant. Awaiting the decision of the jury can be fun.

If everything works perfectly? Don’t hold your breath. Finally watching the criminal being hauled away for 30 to 90 days of confinement might bring you happiness. That, less time already served, in a safe pleasure palace will make him a better person. Especially when he gets three free meals a day plus medical and dental care.

Your medical bills are likely to still be unpaid when he gets out of prison. You can’t send your bills to the police, the prosecutor, the judge, the jury, or the prison for payment. Now, that would really be social justice.

Just as a different idea, and this is not, repeat not, a suggestion for the overthrow of our U. S. Constitutional form of government, just a reform. We have 44 million people without health insurance. The situation getting worse by the day. One way to start to force the issue toward movement to universal health coverage, is for more people in need of medical care to volunteer to do some non-violent white collar “crime”.

Ixnay rimeay, what do they call it today? An "administrative clerical error" like embezzlement. Something that you can quickly plead guilty to, and get “put away”. A place where the government has to provide you with medical and dental care. By the time you’re healthy again, it is likely your sentence will be largely served. You’ll get time off with good behavior and be out soon.

A better solution for society might be for you to stomp on the mugger’s neck when he is down and puking up his guts. Next stomp on the hand holding the knife, take the knife away and cut his carotid arteries with it. Wipe your prints off the knife. Carefully put the knife back in his hand. That way forensics can determine that he committed suicide with it. Then because of blood loss, fell and broke his neck. Police attempting to solve a crime will believe anything that clears a case in less than 24 hours

Of course, you must also be prepared to deal with society and its laws in the case just cited. You must be prepared to deal with the consequences of your actions, if detained, or later arrested.

If there are no witnesses, maybe you should just walk away. Don't run. It calls attention to you.

No need for the police, a judge, a trial, a jury, lawyers, jails and all the expense of maintaining worthless criminals. There’s only a need for a crew to pick up the dead meat. It is good organic fertilizer and they can plant it. The solid waste collection and transfer department already exists. They can do this small additional work at little added cost to the taxpayers. They already have the equipment and the land fill sites. Land fills have been impromptu graveyards for skilled criminals for many years.
